Essentially our patent attorney said not to worry about. As we've established our brand worldwide for years, we have common law ownership.  They'd have to prove they did due diligence to make sure our stuff wasn't used in this industry. Trademarking is a very specific and long process in general. Each version of a logo, colors, phrases etc would need to be done to offer a little bit more "protection"

I'm glad you got legal advice about it. You have such a strong brand it would suck if someone tried to infringe on it. Maybe you could ask your lawyer about at least using the little "TM" on your logos, etc.

By the way, I didn't see it mentioned in the article but if you have a registered trademark and someone infringes there is the possibility you could recover from them three times the amount of your damages.
